Ghoul: Abbas is primarily responsible for the murder of Barghouthi


"GAZA, (PIC)-- MP Mohamed Al-Ghoul, the head of the legal committee of the PLC, held the PA chief Mahmoud Abbas legally responsible for the killing of Sheikh Majd Al-Barghouthi in the intelligence apparatus's jails in Ramallah in his capacity as the top official in charge of this apparatus.

In a statement received by the PIC, MP Ghoul explained that Abbas's responsibility is confirmed in article two of the intelligence law which states that the intelligence is a statutory body operating under the command of the president and performing its duties in accordance with the law.

The lawmaker also held Tawfiq Al-Tirawi secondarily responsible for the murder, citing article five of the intelligence law as a reference which states that the intelligence chief is the competent authority to implement the provisions contained in this law and to specify the terms of reference and tasks of the executive units.

Ghoul added that the PA intelligence apparatus also violated article 11 which states that the intelligence must consider the rights and guarantees enshrined in Palestinian law and the rules of international law.

In another context related to the investigation committee formed by the PA chief, the lawmaker underscored that according to article 48 of paragraph three of the PLC's bylaw, the only authority legally entitled to form a committee to investigate such crime is the PLC, not the PA chief who is considered an accomplice in this felony because he is in charge of the intelligence apparatus.

In a related context, Palestinian eyewitnesses reported that the PA security apparatuses stormed on Monday evening the Khalid hospital in the Irsal neighborhood in the Bireh town in an attempt to arrest doctors and nurses that allowed media photographers to take pictures of torture marks on the body of Sheikh Barghouthi."
